Article 1
Application of These Terms
These Terms and Conditions govern the services provided by Pedro Fernández, trading as NORTH SPAIN (the “Service Provider”). All services provided by the Service Provider are subject to these Terms and Conditions. The Service Provider may amend these Terms and Conditions from time to time. Any amendments will apply to bookings made after the revised Terms and Conditions are published, unless otherwise required by applicable law. The terms applicable to an existing booking will be those accepted by the customer at the time the booking was confirmed.
Article 2
Nature and Scope of Services
Pedro Fernández is duly registered as a self-employed professional under Spanish law, with private tour-guiding services as his principal activity. The Service Provider's activities include tourist guiding, interpreting and translation, as well as other related services.
Article 3
About This Website
This website (https://www.north-spain.com) and all content and materials published on it, including its design, logo, text, videos, images, photographs and audio, are owned by or licensed to Pedro Fernández unless otherwise indicated, and are protected by the copyright and intellectual property laws of Spain and applicable international law. Any unauthorised reproduction, republication, reuse or distribution of such materials is strictly prohibited.
Article 4
Liability and Circumstances Beyond Our Control
To the fullest extent permitted by applicable law, the Service Provider shall not be liable for loss, damage or disruption arising from circumstances beyond its reasonable control, including criminal acts by third parties, illness, adverse or extreme weather, natural disasters, strikes, civil unrest, terrorism, construction works or similar circumstances. Where a service must be changed or cancelled for reasons beyond the Service Provider’s reasonable control, reasonable efforts will be made to offer a suitable alternative where possible. Any refund will take into account the circumstances, any non-recoverable costs already incurred and applicable law. Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.
The Service Provider strongly recommends that customers take out comprehensive travel insurance covering cancellation, medical expenses, personal belongings and other unexpected circumstances.
Article 5
Use of the Information Provided
Any information and advice contained on this website or in emails sent by the Service Provider are provided in good faith for general guidance. Reasonable efforts are made to ensure that such information is accurate when provided; however, local conditions, regulations, opening times, prices and procedures may change without notice. Customers should verify time-sensitive or material information where appropriate. To the fullest extent permitted by applicable law, the Service Provider shall not be liable for loss arising solely from changes to information occurring after it was provided.
Article 6
Personal Data
The Service Provider processes personal data only for legitimate purposes connected with enquiries, bookings, tour preparation and the provision of services, and in accordance with applicable data-protection law. Personal data may be shared with service providers only where necessary to arrange or perform services requested by the customer, or where disclosure is required by law. Personal data will be retained only for as long as necessary for those purposes and to comply with applicable legal obligations. Customers may contact the Service Provider at contact@north-spain.com regarding the exercise of their applicable data-protection rights.
Article 7
Service Cancellation Policy
If a booking is cancelled in whole or in part by the customer, the following cancellation charges shall apply to the Journey Price:
- 14 days or more before the service date: No cancellation charge
- 13 to 8 days before the service date: 50% of the Journey Price
- 7 days or fewer before the service date: 100% of the Journey Price
- Where non-recoverable third-party costs have already been incurred specifically for the booking (including food and drink, accommodation, transport, tickets or admission fees), those actual costs may be deducted from any amount otherwise refundable to the customer. Costs already included in an applicable cancellation charge will not be charged twice.
The Service Provider reserves the right to change or cancel a service where reasonably necessary, including in the event of serious illness or other circumstances that prevent the service from being delivered as agreed. The customer will be notified as soon as reasonably possible. If the Service Provider cancels a service, any part of the Journey Price paid for services not provided will be refunded, subject to any non-recoverable third-party costs and applicable law. Nothing in this clause affects any rights the customer may have under applicable law.
Each service will begin at the scheduled time. If the customer arrives late, the service may be shortened in order to maintain the agreed finishing time. No refund will be due for any part of the service missed as a result of the customer’s late arrival, except where otherwise required by applicable law.
Article 8
Journey Price and Additional Costs
The Journey Price includes only the services and items expressly identified as included in the relevant itinerary or in the “What’s Included” section for that journey. Any service, item or expense not expressly stated as included—including additional admission fees, transport, food and drink, activities, personal expenses or other services—is not included in the Journey Price and must be paid separately by the customer. The Service Provider may arrange additional tickets, restaurant reservations, hotel bookings, shows, transport or other services at the customer’s request. Where advance payment is required, the relevant amount must be paid before the arrangement is confirmed. Amounts paid to third-party suppliers are subject to those suppliers’ cancellation and refund conditions. Any refund obtained from a third-party supplier will be returned to the customer, less any non-refundable charges or costs actually incurred.
